Mediation or Arbitration
Which Path is Right for You?
| Mediation | Arbitration | |
|---|---|---|
| Role of Third Party | Facilitator. (Helps parties reach their own agreement.) | Adjudicator. (Acts as a private judge to decide the case.) |
| Decision Maker | The Parties. (The mediator cannot impose a decision.) | The Arbitrator. (Makes a final, binding decision.) |
| Nature of Process | Collaborative and informal. | Adversarial and quasi-judicial. |
| Outcome | Settlement Agreement. (Binding once signed by both.) | Arbitral Award. (Legally binding and enforceable in court.) |
| Cost & Speed | Generally the fastest and cheapest option. | More expensive than mediation. (Often involves counsel.) |

A New Standard for Litigation
Mediation is no longer always optional. Effective April 2025,
the Gauteng High Court introduced mandatory mediation for all civil trials.
The Reality
The court system faces delays of up to seven years, with some trial dates issued as far ahead as 2031.
The Requirement
A trial date cannot be issued unless accompanied by a formal report from an accredited mediator.
The Benefit
Enrolments following a compliant mediation process aim to be made within 18 months.
